Recruitment Policy

At times, "MFA" (including Moody, Famiglietti & Andronico, LLP and its corporate affiliates. MFA Cornerstone ConsultingMFA Capital AdvisorsMFA Asset ManagementMFA Talent Management and MFA Global) will engage a third-party recruiter to seek resumes for prospective employment applicants. Under those circumstances, MFA will have entered into a definitive written contract for recruiting services, and such contracts will commence and terminate based on the express terms contained therein. To the extent that MFA has entered into a recruiting services contract with a third-party recruiter, such recruiter will be required to submit all resumes for potential applicants to appropriate personnel in MFA's human resources department. Please note that third-party recruiters, headhunters, placement agencies, etc. may not submit unsolicited candidate information to MFA or any of its respective employees or agents unless and until such time as a definitive written contract for recruiting services has been entered into with MFA.

If a recruiter, headhunter or placement agency submits unsolicited candidate information to MFA, its corporate affiliates or any of their respective employees or agents without a definitive agency recruiter contract with MFA in place and in effect, then they do so at their own risk, meaning that (A) MFA will not be liable to the recruiter for any fees or other consideration in the event that MFA hires or otherwise engages such candidate, and (B) MFA will not be liable to the recruiter for any fees in the event that MFA places such candidate in a consulting or employment relationship with any third party. In addition, if a recruiter, headhunter or placement agency submits candidate information to any person at MFA other than MFA human resource representatives who have been designated to receive such information, then MFA will not be liable to the recruiter for any fees or other consideration in the event that MFA hires or otherwise engages such candidate, and MFA will not be liable to the recruiter for any fees in the event that MFA places such candidate in a consulting or employment relationship with any third party. To be clear, all candidate information must be submitted to appropriate MFA human resource representatives to ensure that such candidates are properly input into our system and to track existing contractual obligations between the recruiter and MFA. Accordingly, by submitting candidate information without a definitive agency recruiter contract in place or by submitting candidate information to MFA personnel other than human resource representatives who have been designated to receive such information, recruiters, headhunters and placement agencies consent to MFA soliciting and contacting such candidate, hiring such candidate or placing such candidate with a third party with no obligation to compensate the recruiter whatsoever.
